Is Cash Gifting Legal

By: James M. Shaw

There are many work at home opportunities that sound too good to be true and a lot of them are too good to be true. Most of them involve a business owner to sell a product or service and some of his earnings will go up to the people who sponsored them into that particular business. Pyramid schemes involve people towards the top getting paid on work that the people below them do. When they are proven to be illegal and shut down the people on the bottom are the ones who are hurt the most as they will never see the money they invested again.

The IRS has addressed cash gifting and gifting in general in IRS Publication 950 and Tax Code Title 29. Inside these codes they state people are allowed to gift up to $12,000 during any one calender year to someone else or to another organizations without having to worry about being taxed on the gift. While you can gift more than $12,000 there are different regulations that apply which is beyond the scope of this article. As the United States is a free country and anyone who resides in the U.S. has a constitutional right to give or receive gifts of cash or other items freely.

Things are not always as they seem. It is a real chore to sort through all of the home based or internet based businesses to find out which ones are legitimate and which ones are scams. Doing your due diligence is the best way you can go about avoiding being taken for a ride. Promises of incredible wealth within hours or days are most surely advertising ploys.

People helping each other is what cash gifting is about. People from every walk of life are involved in cash gifting and remain involved in it as it is very rewarding for everyone involved. People who start cash gifting often give gifts to people they have never met. When the gift is given with nothing in return it is by definition a gift and as long as there are no goods or services exchanges then it remains a gift. Some people believe what comes around goes around, and, most people involved in cash gifting will tell you it is as true as the day is long.

Finally, if you have ever been approached by someone involved in cash gifting and maybe were not sure it was above board and legal, do yourself a favor and do some research. You will find it is a perfectly legal way to help people that are less fortunate than you at the same time feeling a great sense of doing the right thing when you give a fellow person a gift of cash.
